Petroleum Act Amendment Process

BACKGROUND AND CONSULTATION

Since enactment of the Petroleum Act 2000 and Petroleum Regulations 2000 in September 2000, PIRSA identified a number of opportunities for enhancement relating to both administrative matters and emergying issues in the petroleum and geothermal industry sectors. A Discussion Draft: Petroleum Act 2000 - Implementation Issues detailing these issues and potential modifications to the Act and Regulations was subject to public consultation in early 2005.

Based on submissions received during consultation on the Discussion Draft, the Department, known then as PIRSA, developed a Green Paper on Proposed Amendments to the Petroleum Act 2000. The Green Paper was released for a 6 month public consultation period at the end of 2006, during which time two workshops were held to allow stakeholders to discuss the proposed amendments.

Based on comments submitted to the department in response to the Green Paper, the Petroleum (Miscellaneous) Amendment Bill 2008 was drafted by Parliamentary Counsel and released for public consultation in July 2008.

AMENDMENT BILL

Following review of the comments received during consultation on the 2008 Bill, the final Petroleum (Miscellaneous) Amendment Bill 2009 was drafted by Parliamentary Counsel and introduced to Parliament on 29 April 2009. The Bill was passed by Parliament on 15 July 2009 and assented to by His Excellency the Governor in Executive Council on 23 July 2009.

Proclamation of the Petroleum (Miscellaneous) Amendment Act 2009 and associated Petroleum Variation Regulations occured on 1 October 2009 so that the Petroleum and Geothermal Energy Act 2000 and associated Petroleum and Geothermal Energy Regulations 2000 are now operational.

PIRSA prepared a document summarising comments received on the draft Bill during the public comment period, along with details of PIRSA's response to each issue raised.
